PERSONAL INFORMATION WE COLLECT

We need accurate, current insurance, health, and financial information about you so that we can determine your insurability and provide products to meet your specific needs at a fair price. We collect personal information that you provide to us on applications, other forms, and in interviews. In addition, we maintain information about your transactions with us, such as policy coverage, premiums, and payment history. We may obtain additional information from third parties which may include agents, employers, other insurers, consumer reporting agencies or health care providers in the course of processing, underwriting or administering your life insurance policies.

We collect this information primarily to appropriately advise you and recommend certain financial services we offer and to obtain the financial services that you desire to purchase through us.



OTHER INFORMATION WE COLLECT

Our web server places a ‘cookie’ on your computer for use in tracking visitors to our website. This information is used only to create traffic reports and analyze your activity on our website. The IP address of your computer, the type of computer and browser you are using, and other similar information is also logged each time you visit our site, and used for the same purpose. ADDITIONAL RIGHTS FOR CALIFORNIA RESIDENTS

The California Consumer Privacy Act of 2018 (CCPA) provides California residents with certain additional privacy rights related to the personal information Treloar & Heisel, LLC. and its divisions (“we”, “us”, or “our”) collect about you. The CCPA provides California residents with rights to know about your personal information we collect and rights to have certain personal information deleted. 

This California Privacy Notice supplements the information contained in Treloar & Heisel, LLC.’s Privacy Policy and applies solely to consumers and all visitors, users and others who reside in the State of California. Terms defined in the CCPA have the same meaning when used in this California Privacy Notice.

This information is collected for a variety of purposes, including enhancing or improving the website or the services we offer to you.

  • Underwrite, sell, solicit, and negotiate insurance products and services.

  • Provide you with support and respond to inquiries.

  • Contact you regarding your account, your orders, upcoming and/or failed payments, renewals and endorsements, or for any other important reason.

  • Provide you with a requested quote or offer goods and services of a third party vendor.

  • Determine eligibility and process applications for products and services.

  • Inform you with products and services we may offer and for other marketing purposes.

  • Communicate, create, service, secure and bill accounts or clients.

  • Obtain and update insurance or credit information with appropriate third parties, such as credit reporting agencies.

  • Monitor and administer accounts and the services thereto.

  • Process requests, purchases, transactions and payments and prevent transactional fraud.

De-Identified Patient Information

We may use or disclose de-identified patient information exempt from the CPPA to third parties for commercially legitimate business purposes.

Right to Know:

You have the right to know certain information about our collection, use, and disclosure of your personal information for the 12 months preceding your request. You may also right to request that we provide you with specific pieces of your personal information. These rights have certain exceptions. Once we receive your request and confirm your identity, we will disclose to you the following:

  • The categories of personal information we collected from you.

  • The categories of personal information sources we collected about you.

  • Our business or commercial purpose for the information.

  • The categories of third parties with whom we shared that personal information.

  • If we sold or disclosed your personal information for a business purpose, a list identifying disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

  • The specific pieces of personal information.

If responding to all or part of your request would conflict with federal or state law, or your personal information is subject to an exemption under the CCPA, we will inform you of that fact. We will respond to the portion of your request that does not conflict with applicable laws and is not exempt under the CCPA.

 

What are My Rights to Have my Personal Information Deleted?

You have the right to have us delete certain personal information we have collected from you, with certain exceptions and exemptions. Upon your request and our verification of your identity, we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or recall conducted in accordance with federal law, or otherwise perform our contract with you.

  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

  • Debug products to identify and repair errors that impair existing intended functionality.

  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.

  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

  • Comply with a legal obligation.

  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

We will delete or de-identify personal information not subject to one of these exceptions from our records and will direct our service providers to take similar action.

 

Making Verifiable Requests:

You may request that we delete personal information we have collected from you. Subject to exemptions, such as a need to retain the information to service products you have purchased from us, we will delete the personal information we have collected from you.

This CCPA Privacy Policy for California Residents supplements the information contained in our above standard privacy policy. This notice is intended to comply with the California Consumer Privacy Act of 2018 (“CCPA”). Terms in this policy, such as personal information, consumers, and service providers, have the same meaning as defined in the CCPA.

Only you, or a person you authorize to act on your behalf may make a verifiable request related to your personal information. You may also make a verifiable request for your minor child. To authorize another person to make a verifiable request for you, you must provide that person with written permission clearly describing their authority to make a request for you. Your agent under a valid Power of Attorney may also make a request for you. You may only submit a request to know twice within a 12-month period.

We will endeavor to confirm receipt of your request within ten (10) business days. Please contact us if you do not receive confirmation within the 10-day timeframe. We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

 

How Will you Verify My Identity If I Make a CCPA Request?

In order to verify your identity, we will collect certain identifying information from you. We will use this information to verify your identity using reasonable methods in order to process your rights request. These methods may include matching information you provided to us with information already maintained by us, through the use of a third party identity verification service, or by personally contacting you.

We will use the information you provide to verify your identity and to respond to your rights request and for no other purpose.

We cannot respond to your request or provide you with personal information if we are not able to verify your identity or authority to make the request or confirm the personal information relates to you.

You are not required to have an account or policy with us to make a verifiable request.

 

Personal Information Sales Opt-Out and Opt-In Rights

If you are age 16 or older, you have the right to direct a business that sells your personal information to third parties not to sell your personal information. Because we do not sell your personal information, we do not provide any mechanism for you to exercise the right to opt out.

 

What Are My CCPA Non-Discrimination Rights?

We will not discriminate against you for exercising your CCPA rights, which means we will not:

  • Deny you products or services.

  • Charge you different prices or rates for products or services, including through granting discounts or other benefits, or imposing penalties.

Minors

We do not knowingly collect online information from children under the age of 13. If we are notified that we have collected personal information of a child under the age of 13 as defined by the Children’s Online Privacy Protection Act (“COPPA”), we will delete the information as quickly as possible. We never sell the personal information of minors under 16 years of age and would not do so in the future without affirmative authorization of the consumer if between 13 to 16 years of age, or the parent or guardian of a consumer less than 13 years of age.
